Terms of Service

The NLdigital Terms apply to all offers made by PlanetNode B.V. and to every agreement under which we deliver goods or services. These are the industry terms published by NLdigital and deposited at the District Court Midden-Nederland, location Utrecht. We use them unchanged.

Departures from and additions to these terms only apply if we agreed them with you in writing. Your own purchase terms or other general conditions are explicitly excluded. An English translation of the terms is available; in the event of a dispute about its interpretation, the Dutch text takes precedence.

The terms consist of thirteen sections. Section 1, the general provisions, always applies. It covers price and payment, the duration and renewal of the agreement, confidentiality and security, among other things.

On top of that, each service is covered by its own section. Web hosting, VPS hosting and game server hosting fall under section 10, Hosting. If you buy or lease hardware from us — a dedicated server, for instance — sections 11 through 13 are the relevant ones: hardware purchases, leasing hardware and maintenance of hardware. If we process personal data on your instructions, section 2, the standard clauses on data processing, applies as well; that is the data processing agreement.

If provisions from different sections conflict, the earlier section prevails, unless we explicitly agreed otherwise in writing.
